Appeals Court Upholds State's Seizure Of Waterfall

POSTED: 11:18 a.m. EST November 6, 2002
UPDATED: 11:19 a.m. EST November 6, 2002

RALEIGH, N.C. -- The state Court of Appeals has upheld a ruling that dismissed three businessmen's protest after the state seized waterfall property in DuPont State Forest.

The court Tuesday upheld a judge's earlier ruling that dismissed the case contractors Mark Searcy and Jerry Whitmire and camp owner Jim Miller filed against the state.

Searcy and Whitmire had crews working on a gated development on 2,200 acres of land surrounded by the DuPont State Forest. That was before the state took the land in October of 2000 to add to the state forest.

The state's top elected officials voted at that time to force the developer to sell the land.

An attorney for the businessmen says he may recommend they take the case to the state Supreme Court.

I don't think we need to do anything. I took this as good news! I can't imagine that the state Supreme Court would overturn this decision.

Hope you're right, Diana. I can't imagine anything other than those gorgeous falls there at Dupont.

For updates on what's happening with the waterfalls and the DuPont State Forest, go to http://www.dupontforest.com. You will also find a link on How to join Friends of DuPont Forest. These folks have done a phenomenal job in helping to preserve and protect the forest and the falls.

... well, I see they've made some major improvements over there, too! They built a nice stairway to get you down to the river & trail near the Hooker Mills parking lot, & otherwise made some safety improvements there. Good! Crossing that road, on the way to Triple & High Falls [from Hooker], was something that had to be fixed.
